A man from Peshawar, Sajjad Khan, was convicted by a local family court for contracting a second marriage without the permission of his first wife and the local council. The court, presided over by Senior Civil Judge Ghulam Hamid, sentenced him to three months imprisonment and fined him Rs5,000. The judge ruled that the complainant, Ms. Fatima, had proven her case against the accused beyond any doubt through reliable evidence.
The case was brought under section 6 (5) of the Muslim Family Law Ordinance, 1961, which deals with polygamy and the procedure for contracting a second marriage. The complainant had previously filed a suit for payment of dower in 2019, which had been decided in her favor. However, the convict had not resettled her and had instead contracted a second marriage without permission. The court ordered an inquiry through the local police, which confirmed that the convict had indeed contracted a second marriage.
